Small CMS Regulated Entities

Under the California Clean Miles Standard Program (CMS), small TNCs, defined as CMS Regulated Entities with less than five million miles of vehicle miles traveled (VMT) in all periods of passenger service in a given calendar year, are exempt from certain program requirements. Each Small CMS Regulated Entity is required to file a Tier 2 advice letter by January 15th of each year to request exemption status for the current calendar year based on its total VMT for all periods in passenger service during the previous calendar year.

 The following reports will be updated within 30 days of any new filing, suspension, or extension and any change of status of an advice letter, including disposition or withdrawal of the advice letter.

 Note on Advice Letter Suspensions: Advice Letters are commonly suspended for additional review by staff. The suspension deadline is the maximum time allotted, and staff may issue a disposition or resolution at any time before the deadline.

*Note on Requests for Commission Review: Per Rule 7.6.3 of General Order 96-B, certain stakeholders may request Commission review of an Industry Division disposition. Accordingly, CPED will prepare a proposed resolution for consideration by the Commission. Approved advice letters remain in effect pending Commission action.
